In February 2004, a new Pennsylvania drunk driving law went into effect that took a tiered approach to drunk driving offenses. There are three tiers of drunk driving charges (called driving after imbibing, or DAI, in Pennsylvania):

General Impairment—.08 to .09 blood alcohol content (BAC)

High BAC—.10 to .159 blood alcohol content

Highest BAC—.16 or more
The penalties increase as your blood alcohol content increases. They increase even further if you are a commercial driver, a minor, or were involved in an accident that caused injuries or property damage while driving drunk. If you refuse a breath or chemical test when asked by the police, you will face the highest level of penalties.
